#1568              Fong, Gordon                                     46 Furnace Street

Applicant seeks two findings and a special permit relative to a proposed enclosed porch with an attached deck to a structure on a nonconforming lot.  Property is located at 46 Furnace St. and is situated in the /rural 1 Zone within the Groundwater Protection District.

Board of Health letter dated 10/10/06 read.  Stating no objections.

Conservation Commission:  Greg Meister gave a verbal no objection on 10/11/06

 

Applicant plans to enclose the existing porch and make it a 3 season porch with a new L shaped deck coming off the 3 season porch.  The proposed 3 season porch will be off the dining room and will have no heat.

 

The proposed living space is 190 sq. ft. and the new deck will extend out 3ft more than the existing deck.

 

The Board has issues with the Board of Health’s title 5 and requested the Applicant to speak with the Board of Health Agent.

 

New plot plan requested.

Applicant seeks a Comprehensive Permit under MGL Chapter 40B, Section 20-23 for development of thirty-two town house condominium units, comprised of nine buildings, plus one existing home located at 9 Glenview Road.  Property is located off Rob’s Lane, Town of Sharon Assessor’s  Map 102-Parcels 87,88 and 92-1 and is zoned Residential B.

John mentioned Peter O’Cain’s letter dated 10/11/06.

 

John Rhoads gave a brief review of the letter dated 8/1/06.

 

                                                                                                                                                                                                                                                  

Bill McGrath, Earth Tech discussed the following concerns: 1) set back of buildings 5 and 6 in the wet land 50 ft. no disturb zone.  2) Encroachment of the 75 ft wet land buffer zone in the no disturb zone.  3) The emergency access should be eliminated because of the grading and being able to access the emergency equipment. 4) concerned with the design of the retaining wall and type of wall.

 

Mr. McGrath also, had landscaping concerns with having enough screening around the septic system and screening for the abutters.

 

Alice Cheyers had issues with the emergency access and the grading.

 

Mary Tobin, Glendale Rd. questioned if there will be any fencing around the retention basin.  Mr. Rhoads responded that there will be a 5 ft. fencing around both retention basins.  Mr. Rhoads also, stated the Applicant will increase the buffer around the septic system.

 

Mike Burke, Traffic Engineer gave a brief review of the stopping site distance on the west side.

 

Mary Tobin had issues with the site and stopping distance is not being safe.

 

Lois Miller had concerns with the emergency vehicles during holiday time.

 

John had the following concerns with buildings 5 and 6 in the 50 ft. no disturb zone, encroachment on the 75 ft. wet land buffer and the height of the retaining walls.  Mr. Rhoads responded that they could reduce the size of the cul-du-sack and that there will be a 5ft fence and guard rail around the retaining wall.

 

Board of Health memorandum dated 10/11/06.  Believes that the setbacks and provisions included in Article 7 are important for the protection of public health and the environment.  The land use pattern and sensitive environmental resources in close proximity to this site necessitate the greater setbacks and the greater system controls that are built into the towns waste water management rules and regulations.

 

Alice Cheyer was interested in seeing the floor plans for the 28 units.

 

Mary Tobin, wanted to know if the septic systems require a ground water mounding system.

 

Mr. Houston has concerns with the ground water mounding system.

 

The Board outlined the following issues that still needed to be clarified: buildings 5 and 6 in 50 ft. no disturb zone, encroachment on the 75 ft. wetland buffer and emergency access grade.

 

Mr. Houston requested the Board review the proforma and economic analysis of the waivers.
